Roderick Alexander Macpherson, who carries on business as Rutherford & Macpherson, is registered with the Information Commissioner’s Office (Reference number Z760092X). His contact information, as data controller and designated data protection officer, is shown at the end of this notice. He and his staff (‘we’ or ‘us’, hereafter) are committed to respecting your privacy, which is protected by law. The General Data Protection Regulation (GDPR) only allows us to use your personal information if we have a legal basis to do so. We therefore must either have your consent, or our reason must be based upon our legal obligation, or our legitimate interest. In the exercise of official authority, all our services as officers of court will be based upon our compliance with legal obligations. In extra-official activities, our tasks are carried out either in the public interest, or within the legitimate interests of us, but without overriding the legal rights of the data subject. Therefore, legal obligations, official authority, and legitimate interests form our lawful basis for processing data.

In receiving instructions as officers of court, we process and store personal information relating to the relevant parties in litigation, or in diligence. We may hold personal information which includes employment or banking information. In extra-official instructions – those being cases that do not involve court warrants – our investigations may involve the collecting of genealogical and financial information. In all cases, the collecting of names, postal addresses, telephone numbers and email addresses will be involved. We also collect data in our role as an employer. We do not collect any personal information from visitors to our website. We may use your information to carry out our official or extra-official functions, thereby disclosing data to our instructing clients and, where necessary, to agents acting on our behalf. We also use personal information in making reports to courts or other authorities, as required by law.

Except for documents which, out of historical interest, are suitable to be kept in an archive for an indefinite period, our information is kept for no longer than ten years. This period allows us to refer, for some years later, to steps taken in legal procedures in cases which may still be matters of importance to the parties. You can obtain a copy of your own personal information, as held by us, by a Subject Access Request. You have the right to question any information we hold about you which you think is wrong or incomplete, and we shall promptly correct or remove any incorrect information.
